Real estate transactions can have a significant impact on your life, your finances, and your business. Whether you’re buying or selling, it’s important to be fully informed and to ensure that every step in the process is completed accurately and on time.

At the O’Grady Law Firm, we’re fully focused on real estate and estate planning matters. We can guide you through the process and protect your interests every step of the way.

Residential Real Estate Matters

Buying a Home

When you purchase a home in North Carolina, there is a lot of important detail work that many people aren’t even aware of. For example, you may know that you need a title search, but not know exactly how that protects you, or what information may be a red flag. We’ll take care of this for you to ensure that:

  • There are no defects in the chain of title that could invalidate your title
  • You are aware of any easements that may impact your use of the property
  • You are aware of any restrictive covenants that could impact your use of the property

We can also ensure that you fully understand the terms of your mortgage loan package and that the paperwork is completed accurately, that the real estate contract and deed convey the interests you are expecting, and that your title is promptly and properly recorded. Working with an experienced real estate attorney from the start allows you to focus on your new home while ensuring that your interests are protected.

Selling a Home

When selling your home, you’ll need to be aware of any required disclosures and make them in the appropriate form. You’ll also need documents prepared, to be sure you know exactly what you’re transferring and it’s as you intended, to understand when and why the buyer can back out, and what rights you have in that situation, and more.

Commercial Real Estate Transactions

Commercial real estate transactions involve all of the same basic issues as listed above. But, they tend to be more complex and require more extensive negotiation. In addition to ensuring that the title is clear and that the contract reflects the intentions of both parties and leaves nothing unaddressed, you’ll need to address matters specific to commercial transactions. For example, you’ll need to ensure that the location is properly zoned for the business you plan to conduct there, and that your operations won’t run afoul of noise restrictions and other regulations.

One key benefit of working with an experienced real estate attorney like Laura O’Grady is that your attorney can ensure that all relevant issues are addressed, even if you may not have known to consider them.

Residential and Commercial Leasing

Renting real property is different from selling or purchasing the property, but comes with a wide range of issues to be resolved–including some that aren’t relevant in a real estate sale. Both the landlord and tenant will need to agree on the terms of the lease, including the rental cost, payment date, grace period, late fees, who is responsible for maintenance, remedies for default, and more. Some of these issues are governed by state law and/or local ordinances. So, you’ll benefit from legal guidance to ensure that your lease is valid and enforceable.

In addition, some of the same issues involved in a sale may come into play, especially in a commercial setting. For example, a commercial tenant will have to ensure that they can legally operate their business in that location, just as a buyer would.
